Terms and Conditions of Supply

The order form in combination with these Terms and Conditions constitute the complete agreement between EyeOns and You as the customer placing an order for goods at EyeOns website.

Customer Obligations

By placing an order or using our services you confirm that you are:

  • 18 years old or older;
  • You are the authorised holder of any credit/debit card You may use on the site;
  • You are able to provide any details reasonably requested by EyeOns to confirm that You are eligible to make a purchase;
  • You have agreed to our storing and processing of your data and you confirm that any data provided by you are correct and complete.

Limitations of Supply

EyeOns will strive to fulfill all requirements specified by you in your order (s) but we cannot guarantee the availability of products. If the products You have ordered cannot be supplied to You, EyeOns will contact You to give You a choice to receive a replacement or a refund. If we receive no response from You, we may provide replacement products of an equivalent quality and/or specification or cancel the Order and provide a refund.

EyeOns tries to ensure that the products supplied match the descriptions provided on the site. Whilst we try to ensure that there are no changes to the products to be supplied, You acknowledge that there may be some minor variations to the description and/or specification of the products which arise by virtue of changes made by the manufacturers, and accept that such minor variations will not give You a right to refuse delivered products.

Prices and Payment

The price you pay for the products shall be the price stated on the site at the time Your Order is placed in accordance with these Terms. All prices shown on the website are correct at the time of display, however we do not warrant that the site is error-free. We reserve the right to change or prices from time to time but once an order has been placed this price will not be altered for that order. Unless otherwise stated on the site, all prices for products are in United States Dollars. You can pay for Products using a debit card or credit card or using PayPal, Google Pay or Apple Pay. We accept the following cards: Visa, Master Card, Maestro, Discover and American Express.

Coupons and Discounts

We aim to keep our products as affordable as possible and often distribute discount coupons and coupon codes through various channels for that purpose. Only one Discount coupon can be used per one order. When combining orders you cannot use multiple coupons. You are not permitted to add coupons retroactively to your order. Any contests, sweepstakes or other promotions made available through the site may be governed by rules that are separate from these Terms of Conditions. Unless otherwise stated in such Promotions’ rules, we reserve the right to terminate and change the terms of any such Promotions at any given time without prior notice.

Return Policy

We do our best to make returns and exchanges as simple as possible.

We are confident that you will enjoy our eyeglasses and contact lenses. However, if you are not completely satisfied with your eyeglasses within the first 14 days after delivery, you are entitled to a refund or product exchange. If you wish to return eyeglasses, it should be in its original packaging and with all accompanying materials including case and cleaning cloth. Contact lenses must be returned unopened, in their original, merchantable condition and must be within 6 months of their expiry date.

To refund the purchase price of the goods we use the same payment method as the Customer used for the original transaction (credit card, debit card, PayPal, etc.). Please allow us up to 30 days from when we receive the item (in respect to cancellations, 30 days from when the cancellation request was submitted), for the credit to appear in your account. Keep in mind that some refunds may take over 30 days from the purchase date to be processed.

Orders

Orders must be placed via the ordering system on the site. By placing an order you confirm that the data provided by you are complete and correct. You may change Your Order within 24 hours of submission to the Site. Any change requested to an Order after this time may be rejected by EyeOns at its absolute discretion. If the Products are no longer available, even after the order has been confirmed, we will let you know. You may then order another Product from our Website or, if you wish, cancel the order. Any payment made will be refunded.

Lack of information in orders may lead to delays in processing such orders. There may be cases in which we will be required to contact you in order to obtain additional information, and such inquiries may also delay the processing of the order. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

The processing time of orders that contain additions to the lens (such as coatings, tint or other) may take longer time.

Shipping Policy

Delivery is performed by sending the goods to an address specified by the customer. The customer warrants and represents that the complete and correct delivery address has been supplied with the order.

Orders will be delivered to the address that appears on your order within reasonable time from the completion of the production and the quality checks.

Orders are usually shipped within 10 days from the date of confirmation of payment; however, there may be delays due to external factors. The time of delivery can vary depending on the destination. Please note that additional local taxes may be applied to shipments to locations outside of the United States.

We shall not be liable for delays in shipment due to faults of the carrier, and therefore these delays will not result in refund of shipment cost, however, we will make reasonable efforts to assist you with respect to such delays in a timely manner.

Please be advised: all international shipments may be subject to customs regulation. Any related charges will be your responsibility. We can’t be held liable for incurred charges.

Once the package is shipped from an EyeOns facility, it is no longer the responsibility of EyeOns but the responsibility of the carrier. It is important that you enter your address correctly. We will not refund or exchange products that were shipped to an inaccurate address as a result of missing details. Shipping claims should be addressed within 30 days from the date of the shipping.

Products that are Defective on Delivery

The rights granted to You under this clause are in addition to, and do not replace, any rights You may have as a consumer under relevant laws, including any consumer protection legislation applicable to Your purchase of the products

Upon delivery of the products You must inspect them carefully. If any of the products do not match the description or appear to be damaged or are missing, do not use the products or any items accompanying the products, and please contact EyeOns by email and inform us of the problem within 5 days of delivery of the products. If we accept that the products do not match the description, or are damaged or missing, the products will be deemed "Defective on Delivery". You must notify EyeOns immediately if there are any defects in the products which are apparent during Your use of the products. If the products are Defective on Delivery, EyeOns will either repair or replace such products or refund the price paid for the products to You. If the products are Defective on Delivery, You agree to return the products to EyeOns in substantially the same condition as when received by You, including all items and packaging accompanying the products.

Manufacturing Defects

The rights granted to You under this clause are in addition to, and do not replace, any rights You may have as a consumer under relevant laws, including any consumer protection legislation applicable to Your purchase of the products.

If You discover a manufacturing defect of any products, You must notify EyeOns immediately. If You return the defective products stating the manufacturing defect to EyeOns, EyeOns shall, at its absolute discretion, repair or replace such products.. EyeOns shall not repair or replace any products if it has not received the defective products back from You or if the defect was caused by misuse or mistreatment of the products.

Liability

EyeOns shall not be liable to You for any loss of contracts, loss of income or revenue, loss of profits, loss of goodwill or loss of insurance cover. EyeOns shall not be liable to You where the loss or damage results from information provided by You that is inaccurate, false or misleading or that otherwise results from a breach by You of these Terms. EyeOns accepts no liability in respect of any non-standard use of the Goods such as, by way of example only, in extreme sports.

Before starting to use your eyewear purchase you should try them on. If you cannot see clearly or if you experience any discomfort or problem in relation to any eyewear product (particularly prescription eyewear and contact lenses) purchased, you should stop using the eyewear in question immediately and you should seek advice from an appropriate medical practitioner without delay, which may include an ophthalmologist, optician or eye doctor. Unless specified otherwise, the sale and supply of products to you by EyeOns does not and cannot constitute the provision of any advice whether of a professional or medical nature or otherwise.

EyeOns shall not be liable for failure to comply with these Terms owing to any act or event beyond its control including but not limited to natural disasters, riots, civil commotion, strikes, shortage of supplies, lock-outs, industrial action, war, disease or fire.
